These terms apply when you use Tempo, an iPhone app made by Arnav Roy ("the developer"). By downloading or using Tempo you agree to them. Tempo is also covered by Apple's Licensed Application End User License Agreement; where these terms and Apple's agreement conflict, Apple's agreement governs.
You get a personal, non-transferable licence to use Tempo on Apple devices you own or control, as permitted by the App Store Terms of Service. You may not sell, redistribute, rent out, reverse engineer or attempt to extract the source code of the app, except where that restriction is prohibited by law.
Tempo is free to download and includes a substantial free tier. Tempo Premium is an auto-renewing subscription:
Prices are in US dollars and may vary by region. Payment is charged to your Apple Account at confirmation of purchase. A subscription renews automatically unless auto-renew is turned off at least 24 hours before the end of the current period, and your account is charged for renewal within 24 hours of the end of that period.
You can manage or cancel your subscription in Settings › Apple Account › Subscriptions. Cancelling stops future renewals; you keep Premium until the end of the period you have already paid for. Any unused portion of a free trial is forfeited when you purchase a subscription. Free trials are limited to one per subscription group per Apple Account.
All purchases are processed by Apple, and refunds are handled by Apple under its policies. The developer cannot issue refunds directly.
Your tasks, habits, notes and everything else you create in Tempo belong to you. The developer claims no ownership over them and, as described in the Privacy Policy, cannot access data held in your private iCloud account.
You are responsible for your own backups. Because your data is stored on your device and in your iCloud account, the developer cannot recover data you delete or lose.
Tempo's focus features use Apple's Screen Time (Family Controls) framework to block apps you select. These features depend on iOS behaving as documented and are not a security control. Do not rely on them to prevent access to anything safety-critical. Strict Focus intentionally prevents ending a session early from inside Tempo; you can always end it by removing Tempo's Screen Time permission or deleting the app.
Don't use Tempo to break the law, and don't attempt to disrupt, overload, probe or gain unauthorised access to the servers that support Premium features. Access to those servers is limited to active subscribers and may be suspended for abuse.
Tempo is provided on an ongoing but not guaranteed basis. Features may be added, changed or removed, and network-dependent features may be unavailable at times. If a change materially reduces what a paid subscription provides, you may cancel and stop future renewals as described above.
Tempo is provided "as is", without warranties of any kind to the fullest extent permitted by law. The developer does not warrant that the app will be uninterrupted or error-free, or that reminders, notifications or blocking will always trigger as expected.
To the fullest extent permitted by law, the developer's total liability arising out of or relating to Tempo is limited to the amount you paid for it in the twelve months before the claim. Nothing in these terms limits liability that cannot be limited by law, and you may have consumer rights that these terms do not affect.
These terms are governed by the laws of the State of New York, United States, without regard to its conflict of laws rules, except where mandatory consumer protection law in your country of residence applies instead.
Updated terms will be posted here with a new date. Continuing to use Tempo after a change means you accept the updated terms.
